PassionFruit Capital Privacy Policy
Effective Date: September 14, 2026
PassionFruit Capital (“PassionFruit,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you visit our website, communicate with us, submit an inquiry or financing application, use an application portal or form that links to this Policy, or otherwise use our commercial-financing brokerage and related services (collectively, the “Services”).
This Policy applies to information PassionFruit processes in connection with the Services. It does not govern a lender, funding source, government agency, referral partner, or other third party acting under its own privacy policy.
1. Information We Collect
Depending on how you interact with us, we may collect the following categories of information.

This may include income, revenue, expenses, assets, liabilities, liquidity, bank and investment information, tax returns, financial statements, projections, debt schedules, collateral information, payment history, credit information, and other information relevant to a financing request.
Submitting information to PassionFruit does not, by itself, authorize us or any third party to obtain a consumer report or credit report. When such a report is needed, any legally required authorization will be requested separately.
Documents and application materials
We may collect documents you provide, such as tax returns, bank statements, financial statements, leases, purchase agreements, organizational records, resumes, property information, construction budgets, business plans, identification documents, and correspondence.
Communications and preferences
We may collect information contained in telephone calls, emails, text messages, forms, meetings, customer-service requests, survey responses, and other communications with us, together with your communication preferences and records of consent, opt-in, and opt-out requests.
Website and device information
When you use our website or online forms, we and our service providers may automatically receive information such as your Internet Protocol address, browser and device type, operating system, referring pages, pages viewed, dates and times of access, approximate location derived from an IP address, and website interactions. We may use cookies, pixels, logs, and similar technologies to operate, secure, and understand use of the Services.
Information from other sources
We may receive information from your employees, co-owners, guarantors, accountants, attorneys, real estate professionals, SBDC advisors, referral sources, lenders, funding sources, public records, data providers, consumer reporting agencies when legally authorized, and other parties involved in or supporting a financing request.
If you provide information about another person, you represent that you are authorized to provide it and, when required, have given that person appropriate notice.
2. How We Use Information
We may use information to:
- respond to inquiries and communicate with you;
- understand your business, project, financing goals, and timing;
- evaluate potential financing strategies and lender fit;
- identify missing information and request supporting documents;
- prepare, organize, analyze, and improve application materials, financial projections, business plans, transaction narratives, and loan packages;
- introduce or submit a financing opportunity to one or more prospective lenders or funding sources selected for potential fit;
- coordinate questions, document requests, underwriting, due diligence, approval, closing, and funding activities;
- provide customer service and maintain our relationship with you;
- operate, secure, troubleshoot, and improve the Services;
- detect and prevent fraud, misuse, security incidents, and other unlawful activity;
- comply with law, regulatory requirements, legal process, and recordkeeping obligations;
- establish, exercise, or defend legal claims;
- send non-marketing service communications;
- send marketing and promotional communications when permitted by law and consistent with your choices; and
- carry out other purposes disclosed when information is collected or that you authorize.
3. Artificial-Intelligence-Assisted Services
PassionFruit may use artificial-intelligence-assisted tools and other automated technologies to support its services. These tools may help us organize and extract information from documents, identify incomplete materials, analyze financial information, prepare draft projections or business-plan materials, develop transaction narratives, compare an opportunity with potential lender criteria, and assist with loan packaging and communications.
Information processed through these tools may be handled by technology providers acting on our behalf. We take steps intended to limit their use of information to providing contracted services and to protect information consistent with applicable law and our agreements.
AI-assisted outputs may be incomplete or inaccurate. PassionFruit personnel remain responsible for the services and materials we provide and may review, correct, or supplement AI-assisted work. PassionFruit does not make a lender’s final credit decision, and our use of AI does not guarantee approval or determine a lender’s final rates, terms, conditions, or underwriting decision. Each lender or funding source applies its own criteria and makes its own decisions.
You may contact us at [email protected] with questions about our use of AI in connection with your information or to request correction of information you believe is inaccurate.
4. How We Disclose Information
We may disclose information to the following categories of recipients.
Prospective lenders and funding sources
To pursue your financing request, we may disclose application materials and personal, business, ownership, financial, credit, collateral, and transaction information to multiple prospective lenders, funding sources, loan participants, underwriters, or related financing parties that we believe may be a potential fit. These recipients may independently evaluate, verify, retain, and use the information under their own legal obligations and privacy practices.
Service providers
We may disclose information to companies that support our operations, including providers of website hosting, cloud storage, customer-relationship management systems, secure forms and application portals, communications, electronic signatures, document management, data analysis, AI-assisted tools, cybersecurity, payment processing, analytics, and professional services. These providers may process information only as permitted by their agreements with us and applicable law.
Advisors, referral sources, and transaction participants
At your direction or when reasonably necessary to provide the Services, we may disclose relevant information to accountants, attorneys, consultants, SBDC advisors, real estate professionals, insurance professionals, appraisal or environmental providers, escrow or title companies, and other participants supporting the transaction.
Legal, compliance, and safety disclosures
We may disclose information when we reasonably believe disclosure is necessary to comply with applicable law, regulation, subpoena, court order, government request, or other legal process; protect the rights, property, or safety of PassionFruit or others; investigate fraud or security incidents; or enforce our agreements.
Business transactions
Information may be disclosed in connection with a proposed or completed merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, subject to appropriate confidentiality protections and applicable law.
With your direction or consent
We may disclose information for other purposes that you request, direct, or authorize.
5. Sale and Sharing of Personal Information
PassionFruit does not sell personal information for monetary consideration. We do not currently share personal information for cross-context behavioral advertising as those terms are defined under California law.
We may disclose information to lenders, funding sources, and service providers for the business and financing purposes described in this Policy. Those disclosures are not intended as sales of personal information. If our practices change in a way that creates additional opt-out rights, we will update this Policy and provide the required method for exercising those rights.
6. Cookies and Online Tracking
We may use essential cookies and similar technologies to operate and secure the website and remember user preferences. We may also use service providers to measure website performance and understand how visitors use the Services.
Our website does not currently respond to legacy browser “Do Not Track” signals. Where legally required and technically supported, we will treat a recognized universal opt-out preference signal, such as the Global Privacy Control, as a request to opt out of sale or sharing. Because we do not currently sell or share personal information for cross-context behavioral advertising, such a signal may not change our present practices.
Third-party websites, embedded media, or application portals may use their own cookies and tracking technologies. Their practices are governed by their own privacy policies.
7. Communications Choices
Marketing emails
You may unsubscribe from marketing emails by using the unsubscribe link in the message or contacting us. We may still send non-marketing communications concerning an inquiry, application, transaction, or legal obligation.
Text messages
If you enroll in a PassionFruit text-messaging program, message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for assistance. You may also request an opt-out by contacting [email protected]. We may send one final non-marketing message confirming an opt-out request. Consent to receive marketing text messages is not a condition of applying for financing, obtaining financing, purchasing services, or completing a transaction.
SMS/Text Messaging Program
PassionFruit Capital may offer an SMS/text-messaging program for individuals who choose to participate. You may opt in by completing the PassionFruit Capital online form at [https://api.leadconnectorhq.com/widget/form/urRWLSqGv3pR7JDOtO58](https://api.leadconnectorhq.com/widget/form/urRWLSqGv3pR7JDOtO58) and selecting the applicable text-message consent checkbox, or through another affirmative opt-in method we provide.
Depending on the consent you provide, text messages may include service-related communications about your inquiry, financing application, document requests, lender communications, underwriting updates, scheduling, closing, and related support. Marketing or promotional messages will be sent only where separately authorized.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. You may also request to opt out by contacting [email protected]. After receiving an opt-out request, we may send one final confirmation message, after which no further messages will be sent unless you provide a new opt-in.
Consent to receive text messages is not a condition of applying for or obtaining financing. Your mobile carrier may impose additional charges, and PassionFruit Capital is not responsible for carrier fees, delays, or delivery failures. We may maintain records of your phone number, consent, opt-in date, and opt-out requests as necessary to administer the program and comply with applicable requirements.
Mobile information sharing
No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes unless you have expressly consented to that sharing with our partners. Mobile information may be shared with subcontractors and service providers that support PassionFruit’s operations—such as customer service, communications, secure forms, application processing, technology, and related support services—when reasonably necessary to provide the Services and subject to appropriate confidentiality and data-protection obligations. This limitation does not prevent disclosures to prospective lenders, funding sources, or other transaction participants when you request or authorize financing services and the disclosure is reasonably necessary to evaluate, structure, package, submit, process, or support your financing request.
8. Data Retention
We retain information for as long as reasonably necessary to provide the Services, manage lender and client relationships, maintain consent and transaction records, comply with legal and regulatory obligations, resolve disputes, enforce agreements, and protect against fraud or security incidents. Retention periods vary according to the type and sensitivity of the information, the status of a financing request, contractual requirements, and applicable law.
When information is no longer reasonably necessary, we may delete it, de-identify it, or securely archive it as permitted by law. Lenders, funding sources, and other independent recipients may apply their own retention policies.
9. Information Security
We use administrative, technical, and physical safeguards designed to protect information against unauthorized access, acquisition, loss, misuse, alteration, or disclosure. These measures may include access controls, authentication, encryption where appropriate, service-provider oversight, staff practices, and security monitoring.
No method of storage or transmission is completely secure, and we cannot guarantee absolute security. Please do not send Social Security numbers, bank-account credentials, tax returns, or other highly sensitive documents through ordinary email or text message unless we have specifically directed you to an approved secure method.
10. Your Privacy Rights
Depending on where you live and which laws apply, you may have the right to request that we:
- confirm whether we process your personal information;
- provide access to or a copy of certain personal information;
- correct inaccurate personal information;
- delete certain personal information;
- disclose categories or specific pieces of information we have collected, used, or disclosed;
- opt you out of certain sales, sharing, targeted advertising, or profiling;
- limit certain uses or disclosures of sensitive personal information;
- provide information in a portable format; or
- review an appeal concerning a denied privacy request.
These rights are subject to legal exceptions and may not apply to every person or transaction. For example, we may need to retain information to complete a requested transaction, comply with law, maintain required records, detect fraud, or establish or defend legal claims.
To submit a request, email [email protected] with the subject line “Privacy Request” or write to the address below. We may verify your identity and authority before completing a request. An authorized agent may submit a request when legally permitted, but we may require proof of authorization and verification of the individual’s identity.
We will not unlawfully discriminate against you for exercising an applicable privacy right.
11. California Privacy Information
California residents may have rights under the California Consumer Privacy Act, as amended, if that law applies to PassionFruit and the information at issue. These may include rights to know, access, correct, or delete personal information and to opt out of certain sales, sharing, or uses of automated decisionmaking technology.
PassionFruit does not currently use automated decisionmaking technology to make a final decision to grant or deny credit. Prospective lenders and funding sources independently make their own underwriting and credit decisions. If our practices or legal obligations change, we will provide additional notices and choices as required.
California’s “Shine the Light” law may permit certain residents to request information about disclosures of personal information to third parties for their own direct-marketing purposes. You may submit such a request using the contact information below.
12. Children’s Privacy
The Services are intended for businesses and adults. They are not directed to children under 18, and we do not knowingly collect personal information from children under 18. If you believe a child has provided information to us, contact us so that we can review and address the matter.
13. Third-Party Websites and Services
The Services may contain links to or integrations with lenders, application portals, video providers, government websites, and other third parties. PassionFruit does not control and is not responsible for their privacy, security, content, or business practices. Review the applicable third-party policies before providing information directly to them.
14. Changes to This Policy
We may update this Privacy Policy to reflect changes in our Services, technology, business practices, or legal obligations. We will post the updated Policy and revise the Effective Date. When required, we will provide additional notice or obtain consent before applying a material change to information already collected.
